Enos Ravhura’s application to prevent his dismissal by Dr Sibongile Zungu, the head of the department, was dismissed by Judge Hamilton Cele, in a judgment obtained by Sapa on Monday.
Cele handed down the judgment late last week.
Ravhura was suspended on full pay along with supply chain manager Andile Zondo on November 26, 2013.
What Ravhura’s offence was has not been revealed by the department, nor the outcome of its disciplinary inquiry.
However, according to the judgment Ravhura was found guilty of a number of charges by an internal disciplinary hearing on September 26, 2014.
Details of the offences are not revealed in the judgment, other than saying: “He had various charges of gross misconduct preferred against him, in the procurement process and involving dishonesty.”
Ravhura had been in his post for little more than a year at the time of his suspension.
At the time, the province’s health MEC Sibongiseni Dhlomo, when announcing the suspensions, also declined to provide details.
“All I can say is that there were irregularities in the execution of their duties,” he said.
At a recent press conference called by the National Education Health and Allied Workers Union in December, the union revealed that Ravhura had been found guilty by the inquiry and the recommended sanction had been to issue him with a final warning.
However, Zungu opted to dismiss Ravhura, and it is this dismissal that Ravhura challenged unsuccessfully in the Labour Court.
It is not known what has come of disciplinary proceedings against Zondo.
Two weeks ago it was confirmed that Zungu was herself being investigated following allegations of mismanagement and corruption.
